"Participant," "you," "your," and "user" refer to any individual who submits a photo or video through the Google Form for the Waken Whitening Photo Submission Promotion or agrees to these terms and conditions.

"Company," "we," "us," "our," "Waken," and "Mintology Limited" refer to Mintology Limited, which is responsible for the organisation and fulfilment of the Waken Whitening Photo Submission Promotion.

"Waken Whitening Photo Submission Promotion" refers to the promotion in which participants submit before-and-after photos or video testimonials demonstrating the effect of using Waken Whitening products, as described in these terms and conditions.

By participating in this promotion, you agree to provide an honest, truthful, and accurate assessment of your experience with our products. Your review should reflect your genuine opinion, regardless of whether it is positive or negative. We encourage all participants to share their authentic experiences to help other users make informed decisions and to contribute to the improvement of our products and services. Any review found to be dishonest, misleading, or intentionally biased may be subject to removal or disqualification from the promotion.

By submitting images and videos to this consumer promotion, you hereby grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and fully sublicensable right and licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such images and videos, in whole or in part, and in any form, media, or technology now known or later developed, including but not limited to our website, social media platforms, and digital advertising campaigns.

You acknowledge and agree that this licence does not transfer ownership of your submitted content, and you retain all rights, title, and interest in the copyright and any other rights you already hold in relation to the images and videos submitted. By participating in this promotion, you represent and warrant that you are the lawful copyright owner or have obtained necessary permissions from the copyright owner to grant the aforementioned licence.

Participation in the Waken Whitening Photo Submission Promotion is open only to legal residents of the United Kingdom who are at least 18 years old at the time of entry. The promotion is subject to all applicable UK laws and regulations and is void where prohibited.

Participants must have used at least one Waken Whitening product to achieve their transformation.

Participants are responsible for ensuring that their submission is original and not copied from another source.

Participants are responsible for ensuring that their photos have not been edited or manipulated in any way. Any photos found to be edited or manipulated will be disqualified.

Waken reserves the right to disqualify any submission that does not meet these terms and conditions or is deemed inappropriate.

By participating in the promotion, you agree to our collection, storage, and use of your personal information for the purposes of this promotion, in accordance with our Privacy Policy (https://wakencare.com/policies/privacy-policy). The company will retain participants' personal data for as long as necessary to fulfil the purposes outlined in the Privacy Policy or these terms and conditions, or as required by law. The company will securely delete or anonymise personal data when it is no longer required for these purposes.

4. SELECTION PROCESS AND REWARD:

Content Selection:

Waken will continuously review and select submitted content based on the clarity of transformation shown in the before-and-after photos, as well as the quality and originality of the photo and video submissions. There is no predetermined timeline for content selection, and Waken may choose to use high-quality content at any time after its submission. Waken reserves the right to reject any submission that does not meet its standards for clarity or that is otherwise inconsistent with the terms and conditions of this promotion.

Definition of Reward:

Participants whose content is selected for use by Waken will receive 2 sets of the Waken Whitening Collection as a token of appreciation.

Delivery of Reward:

Participants whose content is selected will be contacted via email to confirm their shipping address within 14 days of the selection decision. Waken will cover the shipping and handling costs to send the Waken Whitening Collections to the selected participants. The prizes will be dispatched within 30 days of receiving the confirmed shipping address, subject to potential delays due to unforeseen circumstances or factors beyond our control.

The reward is non-transferable and cannot be exchanged for cash or other products.

5. INDEMNIFICATION

By participating in this promotion, you agree to indemnify, defend, and hold harmless Mintology Limited, its subsidiaries, affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable legal fees and costs, arising out of or in any way connected with your submitted content, your violation of these terms and conditions, or your use of Waken Whitening products.

6. GOVERNING LAW AND JURISDICTION:

These terms and conditions, and any disputes arising out of or in connection with their subject matter, shall be governed by and construed in accordance with the laws of England and Wales. You agree to submit to the exclusive jurisdiction of the courts of England and Wales to settle any disputes arising out of or in connection with these terms and conditions or your use of the products.

7. SEVERABILITY:

If any provision of these terms and conditions is found to be invalid, unenforceable, or illegal, the remaining provisions shall continue in full force and effect to the greatest extent permitted by law.

8. CHANGES TO THESE TERMS AND CONDITIONS:

Waken reserves the right to modify or terminate this promotion at any time, without notice.
